BY USING SECURELY SEND THROUGH THE WEBSITE SECURELYSEND.COM YOU INDICATE ACCEPTANCE OF THE TERMS OF USE DEFINED BELOW. YOU AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OF THIS AGREEMENT.

Securely Send may revise these terms of use as well as the privacy policy at any time. Any revision will be noted as a subsection, so please refer back to these documents from time to time.

Securely Send also reserves the right to suspend, discontinue, or terminate user accounts or user files that are in breach of the terms of use at their discretion. Any termination of paid accounts will be refunded for a prorated amount dependent upon unused membership time.

Overview of Services
Securely Send is a web based service that allows users to send messages securely via email as well as upload files to be downloaded by specified recipient(s). Securely Send offers multiple types of accounts including free accounts which allow sending of files with basic features and multiple tiers of paid memberships dependent upon your desired usage. Securely Send may be accessed from most browsers and is not operating system dependent which means it may be used on Windows, Macintosh, or Linux operating systems.

Data Retention
Any files uploaded through Securely Send remain the sole responsibility of the user. By using our services you acknowledge that Securely Send will not be responsible for any files or the ability to retrieve files that have been uploaded to Securely Send servers, as well as any deletion, corruption, loss of data, information, or content within any file(s).

File Restrictions
By using Securely Send you agree to abide by international copyright laws and not to use Securely Send to transmit, make available, or store any material that infringes on any copyrights or promotes violations of intellectual property rights by any third party. As stated above Securely Send does reserve the right to terminate any accounts or delete files(s) that it believes to be in violation of copyright laws.

Warranties and Liability
Securely Send does not provide any guarantee or warrant that use of our services will be error-free or compatible with all hardware or software. The services are provided strictly on an “as is” basis. All conditions, representations, and warranties whether express, implied, statutory or otherwise, including without limitation, any implied warranty of data retention or security are hereby disclaimed to the maximum extent permitted by applicable laws.

In no event shall Securely Send be liable for:
a) any indirect, incidental or consequential damages, including loss of profits, data, or information.
b) any failure to retrieve submitted data or information current or prior
c) compromise or interception of data or messages that has been submitted to Securely Send
